Please read these Terms and Conditions carefully before using the Sibemol Studio website or enrolling in any of our programmes. By accessing our website or registering for a service, you confirm that you have read, understood, and agree to be bound by these terms.
1. Definitions
In these Terms and Conditions, the following words and expressions have the meanings set out below:
- “Company”, “we”, “us”, “our” means GLM Collective S.R.L., trading as Sibemol Studio, a company registered in Romania with CUI 53278696 and registration number J2026002468004.
- “Website” means the website located at www.sibemol.ro and all its sub-pages.
- “Services” means music education programmes, lessons, group sessions, workshops, performances, and any other activities offered by Sibemol Studio, whether delivered in person or online.
- “Student” means any individual enrolled in, or attending, one or more Services.
- “Client” means the person entering into an agreement with us — where the Student is a minor, this is the parent or legal guardian.
- “You” means the visitor, Client, or Student, as the context requires.
- “Content” means all text, images, videos, audio, course materials, logos, and any other material published on the Website or delivered as part of the Services.
2. Acceptance of Terms
By accessing or using our Website or Services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Website or enrol in our Services.
Where a Client is enrolling a minor Student, the Client confirms they have the authority to accept these Terms on the Student’s behalf and accepts full responsibility for the Student’s compliance.
These Terms constitute the entire agreement between you and us in relation to your use of the Website and Services, and supersede all prior arrangements, representations, or understandings.
3. Our Services
Sibemol Studio offers music education for young people through an interdisciplinary method that integrates individual instrument tuition, band-based group training, and live performance experience.
3.1 Service Descriptions
Descriptions of our programmes on the Website are provided for general information only. We reserve the right to adjust the content, format, duration, or delivery of any Service at our reasonable discretion, provided the core educational objectives remain substantially the same.
3.2 Age & Eligibility
Our programmes are designed for young learners. Specific age ranges may apply to individual programmes and will be communicated at the point of enrolment. Where a Student is under 18, a parent or guardian must complete the registration process and accept these Terms.
3.3 Online vs. In-Person Delivery
Some Services may be offered in-person at our studio in Voluntari, Ilfov, or remotely via video call. The mode of delivery will be confirmed at the time of booking. We are not liable for technical failures outside our control that affect the quality of remote sessions.
4. Enrolment & Booking
4.1 Registration
To enrol in a Service, you must complete the booking or reservation process via the Website or as otherwise directed by us. By submitting a booking, you make an offer to purchase the relevant Service, which we may accept or decline at our discretion.
4.2 Confirmation
A booking is confirmed only when you receive written confirmation from us (by email or other agreed means). We reserve the right to decline any booking without providing a reason.
4.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep that information up to date. We are not responsible for issues arising from inaccurate information provided by you.
4.4 Scheduling
Session times are agreed at the point of enrolment. We will make reasonable efforts to maintain the agreed schedule but reserve the right to reschedule a session with reasonable notice due to teacher unavailability, force majeure, or other circumstances beyond our control. A rescheduled session does not entitle you to a refund.
5. Payments & Fees
5.1 Pricing
Fees for our Services are as set out on the Website or as communicated to you directly. All prices are stated in Romanian Lei (RON) and include VAT where applicable.
5.2 Payment Terms
Payment is due in advance of each session or programme period, unless otherwise agreed in writing. We reserve the right to withhold access to Services where payment has not been received.
5.3 Late Payment
If payment is not received by the agreed due date, we may suspend the Student’s place until payment is made. Repeated late payments may result in termination of the enrolment.
5.4 Price Changes
We reserve the right to revise our fees at any time. We will give at least 30 days’ written notice before any price change takes effect for existing Students. Continued enrolment after the notice period constitutes acceptance of the new fees.
6. Cancellation & Refunds
6.1 Cancellation by the Client
If you wish to cancel an individual session, you must provide at least 24 hours’ notice before the scheduled start time. Sessions cancelled with less than 24 hours’ notice, or missed without notice, will be forfeited and no refund or make-up session will be offered.
6.2 Cancellation of Enrolment
To cancel an ongoing enrolment, you must notify us in writing. Fees already paid for sessions that have not yet taken place will be refunded on a pro-rata basis, less any applicable administrative charge, provided that written notice is given at least 14 days before the next billing period.
6.3 Cancellation by Sibemol Studio
We reserve the right to cancel or discontinue a Service, programme, or individual session at any time. In such cases, we will provide reasonable notice and offer either a rescheduled session or a proportionate refund of fees paid.
6.4 Statutory Rights
Nothing in these Terms affects your statutory rights under Romanian consumer protection law, including the right of withdrawal applicable to distance contracts under Government Ordinance no. 34/2014.
7. Student Conduct
7.1 Expected Behaviour
All Students are expected to treat teachers, staff, and fellow Students with respect. Behaviour that is disruptive, disrespectful, or harmful will not be tolerated.
7.2 Studio Rules
Students and accompanying persons must follow the rules of our studio space, including any health, safety, and access requirements communicated to you at enrolment or on-site.
7.3 Termination for Misconduct
We reserve the right to suspend or terminate a Student’s enrolment, without refund, where conduct is deemed by us to be unacceptable. In serious cases, this action may be taken without prior warning.
7.4 Minors
Parents and guardians are responsible for the behaviour of minor Students. Drop-off and pick-up arrangements are the sole responsibility of the parent or guardian. Sibemol Studio does not assume in loco parentis responsibility outside of scheduled session times.
8. Intellectual Property
8.1 Ownership
All Content on the Website and all course materials, lesson plans, arrangements, recordings, and other materials created by Sibemol Studio are the exclusive intellectual property of GLM Collective S.R.L. or its licensors. All rights are reserved.
8.2 Permitted Use
You may access and use Content solely for your personal, non-commercial use in connection with the Services. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content without our prior written consent.
8.3 Student Work
You retain ownership of any original compositions or recordings created solely by the Student. However, by participating in our programmes, you grant us a non-exclusive, royalty-free licence to use recordings, photographs, or videos of Student performances for promotional and educational purposes, subject to our Privacy Policy and any separate consent provided.
8.4 Feedback
Any feedback, suggestions, or ideas you share with us may be used by us freely and without obligation to compensate you.
9. Limitation of Liability
9.1 No Warranty
The Website and its Content are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or suitability of any Content for any particular purpose.
9.2 Exclusion of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive loss or damage arising from your use of the Website or Services, including but not limited to loss of data, loss of revenue, or loss of opportunity.
9.3 Cap on Liability
Our total aggregate liability to you in connection with these Terms shall not exceed the total fees paid by you to us in the three months preceding the event giving rise to the claim.
9.4 Personal Injury
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
10. Data & Privacy
We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms and Conditions. By using our Services, you acknowledge and agree to the processing of your personal data as described therein.
We comply with the General Data Protection Regulation (GDPR) as applied in Romania and with all applicable Romanian data protection legislation. Our data protection authority is ANSPDCP (www.dataprotection.ro).
11. Changes to These Terms
We may revise these Terms and Conditions at any time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will notify existing Clients by email or via a prominent notice on the Website.
Your continued use of the Website or Services after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Website and notify us that you wish to terminate your enrolment.
12. Governing Law & Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of Romania. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Romanian courts.
